Terms of Service — CoolbyBeatShop

1. Acceptance of Terms

By accessing or using CoolbyBeatShop ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all visitors, users, and customers.

2. Description of Service

CoolbyBeatShop is an online beat marketplace that allows artists and music producers to discover, purchase, and download instrumental beats under various license types. We also offer a custom beat production service for tailor-made instrumentals on demand.

3. Accounts

You must create an account to purchase beats. You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account. You must provide accurate, complete information during registration. You must be at least 13 years old to use the Platform.

4. Purchases & Licenses

All beat purchases grant you a non-exclusive, non-transferable license according to the license tier selected:

Standard License — Personal use, non-commercial projects, up to 10,000 streams.
Premium License — Commercial releases, up to 500,000 streams, music videos.
Unlimited License — Unlimited distribution, radio broadcasting, sync licensing.
Exclusive License — Full exclusivity. Beat removed from catalog after purchase.

You do not obtain ownership of the master recording or copyright. The producer retains all rights not expressly granted.

5. Download Links

Download links provided after purchase are valid for 7 days from the purchase date. You can re-access your downloads at any time from your dashboard. We recommend downloading your files immediately after purchase.

6. Refund Policy

Due to the digital nature of our products, all sales are final once a file has been downloaded. If you experience a technical issue preventing download, contact support within 48 hours and we will resolve the issue or issue a refund at our discretion.

6 bis. Right of Withdrawal — EU Consumer Rights

Pursuant to article 16(m) of the EU Consumer Rights Directive 2011/83/EU, the 14-day right of withdrawal does not apply to digital content that is delivered before the end of the withdrawal period, when the consumer has given prior express consent and acknowledged the loss of this right.

By completing your purchase and clicking the "Pay" button, you:

Expressly consent to the immediate delivery of the digital beat files.
Acknowledge that you lose your 14-day right of withdrawal as soon as the download link is generated and made available to you.
Confirm that you have read and accepted the present Terms before purchase.

Custom-beat services (orders involving production work on demand) are also governed by this waiver: the 50% deposit is non-refundable once production has started, and the 50% balance is non-refundable once the delivery link has been sent.

7. Prohibited Uses

You may not use the Platform to:

Redistribute, resell, or sublicense purchased beats beyond the scope of your license
Use beats in content that promotes hate, violence, or illegal activity
Attempt to circumvent copy protection or digital rights management
Upload audio files containing viruses or malicious content
Use automated bots or scrapers without written permission

8. Intellectual Property

All beats on the Platform are owned by their respective producers. CoolbyBeatShop does not claim ownership of producer content. The Platform itself, including its design and code, is owned by CoolbyBeatShop.

9. Limitation of Liability

CoolbyBeatShop is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance.
